Introduction Welcome to Southern Luxury Cakes, LLC. Orders, Quotes, and Custom Designs a. Orders: All orders placed through the website are subject to acceptance by Southern Luxury Cakes. A confirmation email does not guarantee acceptance; acceptance is confirmed once we send a final confirmation or invoice. b. Quotes and Estimates: Quotes provided online or by staff are estimates. Final pricing may vary based on design changes, custom requests, ingredient or supply changes, and labor. We will communicate any price changes prior to final confirmation when possible. c. Custom Designs: We offer custom and bespoke cake designs. By providing images, inspiration, or design concepts, you grant us permission to use those materials for design and production purposes. You represent that you own or have rights to use any materials you submit.
Deposits, Payments, and Cancellation a. Deposits: A non-refundable deposit may be required to secure event dates or custom orders. Deposit amounts and payment deadlines will be provided at time of booking. b. Final Payment: Final payment is due by the date specified in your invoice, typically prior to delivery or pickup. We may require full payment in advance for online orders. c. Accepted Payment Methods: We accept the payment methods listed on the website. All transactions are processed in U.S. dollars. d. Cancellation and Refunds: Unless otherwise stated in a separate written agreement, deposits are non-refundable. Orders canceled within a specified window before the event (as provided in your invoice or confirmation) may forfeit deposit and could be responsible for additional fees. Refunds, if any, will be issued at our discretion and may be subject to processing fees.
Delivery and Pickup a. Delivery: Delivery fees, times, and availability will be communicated at checkout. We will make commercially reasonable efforts to deliver on agreed dates and times but are not responsible for delays caused by traffic, weather, third-party vendors, acts of God, or other factors beyond our control. b. Pickup: For pickup orders, customers are responsible for collecting items during the agreed pickup window. Late pickups may result in additional fees or cancellation at our discretion. c. Risk of Loss: Risk of loss passes to you upon delivery or pickup. Please inspect items at delivery/pickup and notify us immediately of any issues.
Allergens, Dietary Requests, and Food Safety a. Ingredients and Allergens: While we take precautions to prevent cross-contamination, our facilities handle common allergens (including but not limited to eggs, milk, wheat, soy, tree nuts, peanuts). We cannot guarantee allergen-free products. You are responsible for informing us of any allergies or dietary restrictions. b. Special Dietary Requests: Requests for vegetarian, vegan, gluten-free, or other special dietary items are accommodated when possible but must be confirmed in advance and may require additional fees and separate preparation timelines. c. Food Safety: We adhere to applicable health and safety regulations. We are not responsible for adverse reactions or allergies if you fail to disclose relevant information.
Intellectual Property a. Ownership: All content on the website, including text, images, designs, trademarks, logos, and other materials, is owned by Southern Luxury Cakes or used under license. You may not reproduce, distribute, modify, or create derivative works from our content without our written permission. b. Customer Materials: By submitting images, logos, or other materials for use in a custom order, you grant Southern Luxury Cakes a non-exclusive, royalty-free license to use those materials for production and promotional purposes (portfolio, social media, and marketing), unless otherwise agreed in
